Regulations of the online store BEERDURO: WWW.BEERDURO.STORE

Preliminary provisions

The online store BEERDURO available at the website www.beduro.store is operated by BEERDURO s.c., registered in the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, Tax Identification Number (NIP) 5472218909, REGON 386040606.

  1. These Regulations apply to both Consumers and Entrepreneurs using the Store and specify the rules for using the online Store and the principles and procedure for concluding Distance Sales Agreements with the Customer through the Store.

Definitions

Consumer - a natural person entering into an agreement with the Seller within the Store, whose object is not directly related to their business or professional activity.

Seller - a natural person conducting business activity under the name BEERDURO s.c., registered in the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, Tax Identification Number (NIP) 5472218909, REGON 386040606.

Customer - any entity making purchases through the Store.

Entrepreneur - a natural person, legal person, or organizational unit not being a legal person, which has legal capacity under separate regulations, conducting business activity on its own behalf, using the Store.

Store - an online store operated by the Seller at the website www.beerduro.store.

Distance contract - a contract concluded with the Customer within an organized system of concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, exclusively using one or more means of distance communication until the conclusion of the contract.

Regulations - these store regulations.

Order - a declaration of will of the Customer submitted using the Order Form and aiming directly at concluding a Sales Agreement for a Product or Products with the Seller.

Order form - an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

Cart - an element of the Store's software where selected Products for purchase are visible to the Customer, and there is also the possibility of determining and modifying Order data, in particular the quantity of products.

Product - a movable item/service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.

Sales Agreement - a sales agreement for a Product concluded or to be concluded between the Customer and the Seller through the online Store. The Sales Agreement also includes - applying to the characteristics of the Product - a service agreement and a work agreement.

Technical requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:

an end device with access to the Internet and an internet browser,

an active email account,

enabled support for cookies files,

installed FlashPlayer program.

General information

To the widest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the Customer's technical infrastructure.

Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products available in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing necessary personal and address data enabling the Order to be processed without creating an Account.

The prices given in the Store are given in Polish zlotys and Euro and are gross prices (including VAT).

The final amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including fees for transport, delivery, and postal services), which the Customer is informed about on the Store's pages when placing the Order, including at the time of expressing the will to be bound by the Sales Agreement.

In the case of an Agreement covering a subscription or the provision of services for an indefinite period, the final (total) price is the total price including all payments for the settlement period.

When the nature of the subject matter of the Agreement does not allow, reasonably assessed, for the earlier calculation of the final price, information on how the price will be calculated, as well as on fees for transport, delivery, postal services, and other costs, will be provided in the Store in the Product description.

Order placement rules

To place an Order, you need to:

log in to the Store (optional);

choose a Product that is the subject of the Order, and then click the "Add to cart" button (or equivalent);

log in or use the option to place an Order without registration;

if the option to place an Order without registration is chosen - complete the Order Form by entering the recipient's data and the address to which the Product is to be delivered, select the type of shipment (method of Product delivery), enter invoice data if different from the recipient's data,

click the "Order and pay" button / click the "Order and pay" button and confirm the order by clicking the link sent in the email message,

choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period, subject to § 8 point 3.

Offered delivery and payment methods

The Customer can use the following delivery or collection methods for the ordered Product:

Courier delivery,

Personal pickup available at the address: 43-300 Bielsko-Biała, ul. Wypoczynkowa 10

The Customer can use the following payment methods:

Payment by bank transfer to the Seller's account

Electronic payments

Payment by payment card.

Performance of the Sales Agreement

Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Store's electronic system, according to § 6 of the Regulations.

After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. The confirmation of receipt of the Order and its acceptance for processing is made by sending the Customer an appropriate e-mail message to the Customer's e-mail address provided during the Order placement, which contains at least the Seller's declaration of receipt of the Order and its acceptance for processing and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail message by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

If the Customer has chosen:

payment by bank transfer, electronic payment or payment by payment card, the Customer is obliged to make the payment within 7 calendar days from the date of the Sales Agreement - otherwise, the order will be canceled;

personal pickup - the Product will be ready for pickup by the Customer within [14] calendar days from the date of the Sales Agreement.

The right to withdraw from the contract

A consumer who has concluded a distance contract may, within 14 calendar days, withdraw from it without giving any reason and without incurring costs, except for the costs specified in § 10 points 3, 4 and 5 of the Regulations.

The deadline to withdraw from the contract begins:

for a contract in which the Seller releases the Product, being obliged to transfer its ownership (eg Sales Agreement) - from taking possession of the Product by the Consumer or a third party indicated by the Consumer, other than the carrier, and in the case of a contract which:

includes many Products that are delivered separately, in batches or in parts - from taking possession of the last Product, batch or part,

consists in regular delivery of Products for a definite period - from taking possession of the first of the Products;

for other contracts - from the date of concluding the contract.

In the case of withdrawal from a distance contract, the contract is considered void.

The Seller is obliged to immediately, not later than within 14 calendar days from the date of receipt of the Consumer's statement on withdrawal from the contract, return all payments made by him, including the cost of delivery of the Products (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method offered by the Seller), and if the Consumer has expressly chosen a delivery method other than the cheapest usual delivery method offered by the Seller, the Seller is not obliged to refund the additional costs incurred by the Consumer.

If the Consumer has exercised the right to withdraw from the contract but has chosen a method of delivery other than the cheapest usual delivery method offered by the Seller, the Seller is not obliged to refund the additional costs incurred by the Consumer.

The reimbursement will be made using the same payment methods that were used by the Consumer in the original transaction unless the Consumer has explicitly agreed to a different solution that will not involve any costs for him.

The Seller may withhold the reimbursement of payments received from the Consumer until the Product is returned or the Consumer provides proof of its return, depending on which event occurs first.

The consumer is obliged to return the Product or deliver it to the Seller immediately, not later than 14 calendar days from the date on which he withdrew from the contract. The deadline is met if the Consumer sends back the Product before the expiry of the 14-day period.

The consumer bears the direct cost of returning the Product, including the cost of returning the Product, if - due to its nature - the Product cannot be returned by regular mail.

The consumer is liable for a decrease in the value of the Product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

The right to withdraw from a distance contract is not available to the Consumer in relation to contracts in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specification or serving to satisfy his individual needs.

The right to withdraw from a distance contract is not available to the Consumer in relation to contracts in which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons if the packaging was opened after delivery.
